Lawyer Files Petition Seeking to Remove ChiefJustice David Maraga from Office
A petition seeking to have Chief Justice David Maraga kicked out from office has been filed with the National Assembly.
In a petition filed on Monday, lawyer Adrian Kamotho Njenga wants Justice Maraga and six other ejected from the Judicial Service Commission (JSC) on grounds of violation of the Constitution, gross misconduct and incompetence.
The advocate argues that Maraga, Deputy Chief Justice Philomena Mwilu, Justice Mohamed Warsame, Justice Aggrey Muchelule, Prof Tom Ojienda, Ms Emily Ominde and Mercy Deche are unfit to hold office.
“The aforementioned JSC Commissioners have failed to promote and facilitate the independence and accountability of the Judiciary and the transparent administration of Justice contrary to Article 172 (1) of the Constitution,” said Kamotho.
In the petition received by Parliamentary Service Commission (PSC) , Kamotho further alleges that the seven JSC officials have in the past violated Chapter 6 of the Constitution on integrity.
He also says the officials have previously committed acts of gross misconduct in the execution of their roles as JSC commissioners.
Njenga further alleges that Maraga and Co have shielded, protected and exonerated judges said to have been engaged in gross misconduct.
“They have without any constitutional regard or justification dismissed petitions presented to the JSC,” he avers in his letter to the National Assembly.
