Eyes on apex court as midnight deadline for presidential petition fast approaches

Opposition chief Raila Odinga or another party have until midnight to file a petition challenging President Uhuru Kenyatta’s re-election in the fresh presidential polls on October 26.

The Constitution provides seven days for the filing of such a petition in the Supreme Court following the declaration of a winner.

President Kenyatta who was declared president-elect on Monday last week, has expressed a willingness to once again subject himself to the jurisdiction of the Supreme Court despite his verbal assault on their September 1 decision to annul his August 8 win.

Odinga who won that round in the Supreme Court has been non-committal on whether a Supreme Court petition forms part of his resistance arsenal.

Odinga is resisting the outcome of last month’s polls having withdrawn from the race for the reason that it did not meet the credibility criteria set out by the Supreme Court when it annulled the August 8 exercise.

Several other petitions have already been filed before the Supreme Court including by activist Okiya Omtatah who wants the election invalidated on account of Odinga’s withdrawal and by the Pokot South Member of Parliament David Pkosing who wants the Supreme Court to declares said withdrawal “inconsequential.”
