The Error: While the Governor and his sister managed the estate (including 100 acres in Miwani and flats in Nairobi), they were accused of concealing material facts by leaving out the children of their deceased sisters.
The Legal Reality: In Kenya, the Law of Succession Act is a fixed equation. If a sibling dies, their children (your nephews and nieces) legally represent them. You cannot “delete” them from the beneficiary list.
The Penalty: Because this “calculation” was wrong, the High Court revoked the Governor’s administrative power and even fined him and his sister Sh400,000 for contempt when they didn’t follow the court’s orders to include the nephews.
